Terms of Sale
Effective Date: December 2025
These Terms of Sale (“Terms”) apply to all purchases and services provided by Tennessee Mountain Tributes (“TMT,” “we,” “us,” “our”). By signing or accepting our service agreement or contract (“Contract”), paying an invoice, or authorizing us to perform services, you (“Customer,” “you”) agree to these Terms.
1) What we provide
1.1 Service description. We create and hand deliver memorial tribute items to a cemetery or other memorial location in Tennessee and place them at or near a specified burial or memorial site (“Service,” “Tribute,” “Placement”).
1.2 Photo confirmation. After placement, we provide confirmation by email with a password protected album link containing photos showing the Tribute at the memorial site at the time of our visit (“Photo Confirmation”).
1.3 No ongoing care. We do not provide ongoing monitoring, maintenance, watering, cleaning, repairs, retrieval, or replacement after placement unless explicitly agreed in writing.
2) Tribute tiers and what is included
All orders are custom invoiced. Your invoice and Contract describe what is included for your specific order. If there is a conflict between your invoice and these Terms, the invoice controls for included items.
2.1 Standard Tribute.
TMT selects the Tribute design based on season, availability, and what we believe is most appropriate for the time of year.
Customers do not select specific florals, colors, containers, or exact design details.
Optional pick. Upon request, we can include one commemorative “pick” (for example, birthday, anniversary, holiday, or short message) at no additional charge, subject to availability and cemetery rules. The style and wording options are limited to available inventory.
Minor variations are normal and are not grounds for refund.
2.2 Military Tribute.
Options and details (for example, red, white, and blue theme, branch color theme, and available accents such as an American flag, branch accent, rank accent, or similar elements) will be discussed with you before we send the invoice.
Final layout and exact components may vary based on availability and cemetery rules.
2.3 Custom Tribute.
Custom orders are planned with you before invoicing. You may request specific items and features, including but not limited to color themes, containers, shepherds hooks, solar lights, bird feeders, and other decorations.
We may decline requests that, in our judgment, risk property damage, violate cemetery rules, require permanent mounting, digging, wiring, or modification to cemetery property, or are unsafe or inappropriate for the location.
3) Headstone type and placement method
3.1 Appropriate arrangement for the memorial type. We will deliver an arrangement appropriate to the headstone or memorial type based on the information you provide and what is present at the site.
3.2 Common placement methods. Depending on the memorial type, we may use one or more of the following methods, as discussed before purchase and reflected on the invoice when applicable:
Headstones with an integrated vase, we typically provide a vase insert.
Upright headstones, we typically provide a saddle that clips to the top (when feasible and appropriate).
Markers without a vase and not upright, we may offer a green temporary ground vase, or a ground placed saddle style arrangement (non permanent), subject to cemetery rules and site conditions.
3.3 Customer provided information. You are responsible for providing accurate memorial details when requested (for example, whether there is a vase, upright monument, flat marker), and for sharing photos or a pin when available. If the memorial type is different than described and the planned method will not work, we may need to reschedule or adjust the design.
4) Ordering, acceptance, and payment
4.1 Workflow. In most cases, we send the Contract and then an invoice.
4.2 Order acceptance. An order is accepted when you pay the invoice. Payment confirms you accept the Contract, these Terms, and the invoice description of the Service.
4.3 Payment required before service. We schedule and perform services after payment unless we agree otherwise in writing.
4.4 Contact information. You must provide a working email address. You are responsible for checking spam folders and ensuring you can receive emails and links from us.
5) Delivery timing, scheduling, and access
5.1 General delivery timeline. We aim to complete placement within approximately two (2) weeks after the invoice is paid unless we tell you otherwise in writing (for example, holiday volume, severe weather, cemetery access limits, custom sourcing).
5.2 No exact time guarantee. We do not guarantee a specific date or time unless explicitly stated in writing.
5.3 Access and safety. Cemeteries may have gates, limited hours, maintenance closures, restrictions, or safety issues. We may reschedule due to weather, unsafe conditions, closures, or access limitations.
6) Gravesite information, cemetery rules, and the two attempt promise
6.1 Information you must provide. You are responsible for providing accurate information so we can locate the memorial site, including cemetery name and location, decedent name, and any plot, section, lot, or identifying details available.
6.2 Cemetery rules. You are responsible for knowing and following cemetery decoration rules, except for rules that are clearly visible and posted upon entry, which we will make reasonable efforts to observe when seen. Cemeteries may enforce rules inconsistently, and we do not control enforcement.
6.3 Our research efforts. We may attempt to locate memorial sites using information you provide and public resources. Research improves success but does not guarantee location or access.
6.4 Two attempt promise for single orders. For single order deliveries, we will attempt placement up to two (2) times when feasible.
6.5 After the first failed attempt. If the first attempt fails due to missing or insufficient information or access details (for example, unclear location, missing GPS coordinates when needed, missing gate code, or similar), we will contact you to reschedule and request needed details.
6.6 Customer response deadline. You must respond within seven (7) days of our request for additional details. If you do not respond within that timeframe, we may pause scheduling until you respond, and the timeline in Section 5.1 may no longer apply.
7) Duration of placements and responsibility after placement
7.1 Duration of placements. Placements remain on the burial or other memorial site for a period of time consistent with the rules and regulations of the cemetery or other memorial location.
7.2 Public locations. Memorial locations are visited by other members of the public. While we want to hear from you about any concerns you may have with respect to placements, we are not responsible in the unlikely and unfortunate event that any placements are moved or stolen.
7.3 Risk transfers after placement. Once the Tribute is placed and Photo Confirmation is provided, you agree TMT is not responsible for items that are damaged, moved, stolen, weather impacted, vandalized, disturbed by animals, or removed after our visit.
7.4 Cemetery actions. Cemeteries may remove, discard, relocate, or restrict decorations for mowing, maintenance, policy, safety, or other reasons, sometimes without notice. We are not responsible for these actions.
8) Optional removal and disposal of old decor
8.1 Removal by request only. Upon your request, we can remove and dispose of old or existing decor at the memorial site.
8.2 No return of removed items. Any decor removed by us will be disposed of and will not be returned to you.
8.3 Limitations. We may decline removal if it appears the items belong to someone else, removal is prohibited by cemetery rules, or removal risks property damage or conflict.
9) Photo Confirmation, delivery, and marketing use
9.1 Proof of completion. Photo Confirmation is our proof that the Tribute was placed at the time of service. Photos are not a guarantee that the Tribute will remain afterward.
9.2 Photo delivery timing. We aim to email Photo Confirmation within forty eight (48) hours after placement. Timing may be affected by connectivity, travel, or circumstances outside our control.
9.3 Marketing use. We will never use your photos for marketing without your explicit permission. If you provide permission, we will blur personal details when reasonably possible.
10) Pricing, payments, and chargebacks
10.1 Payment methods. We accept payment methods made available through our invoicing and checkout provider.
10.2 Chargebacks. If you file a chargeback after we provide Photo Confirmation or other proof of completion, we may provide documentation to the payment processor, including photos, communications, and service notes.
11) Cancellations, changes, and refunds for single orders
11.1 No cancellations after payment. All sales are final once paid, due to the nature of tribute design, sourcing, and scheduling, except as stated in this section.
11.2 Changes. Change requests are not guaranteed. We will try to accommodate changes when feasible, but changes may not be possible once assembly or sourcing begins.
11.3 Refunds and the $50 location and research fee. If we cannot complete a single order after two attempts due to customer provided information issues or access details not provided (for example, inability to locate the grave with the provided information, missing GPS coordinates when needed, missing gate code), we will issue a refund minus a $50 location and research fee.
11.4 No fee for circumstances outside your control. If the inability to complete a single order is due only to conditions outside your control (for example, repeated cemetery closure, severe weather, or other access issues not caused by missing information), we will refund the full amount paid, or reschedule, at our discretion.
11.5 No refunds after completion. Once the Tribute is placed and Photo Confirmation is provided, no refunds are available due to factors outside our control.
12) Order cancellation by us
We reserve the right to cancel (or to refuse to accept) any orders for any reason, including (i) the sale or transfer of a cemetery or other memorial location, (ii) the discontinuation or material modification of our floral placement services, or (iii) at the request of the individual responsible (the “Responsible Person”) for the burial or other memorial site where you have requested that floral placements be made. Note that the Responsible Person may request cancellation of placements for any reason, including if you have not separately notified the Responsible Person that you are the purchaser. If payment has been received for an order that is cancelled by us, you will receive a refund for any item(s) that will not be placed as a result of the cancellation.
13) Peace of Mind Plan (annual plan, four seasonal placements)
13.1 Plan name and inclusions. The annual plan is called the Peace of Mind Plan and includes four (4) placements, one per season, beginning in the season you enroll.
13.2 No auto renewal. The Peace of Mind Plan does not automatically renew.
13.3 Season dates. Seasons are defined as:
Winter: December 1 to February 28 (February 29 in leap years)
Spring: March 1 to May 31
Summer: June 1 to August 31
Autumn: September 1 to November 30
13.4 Scheduling. We schedule placements on dates that align with the seasons unless you request otherwise (for example, birthday, anniversary, memorial date). Special date requests are not guaranteed and must be provided as early as possible.
13.5 Two attempt promise per season. For each seasonal placement, we will attempt delivery up to two (2) times when feasible.
13.6 Reschedule after first failed attempt. If the first attempt fails, we will contact you to reschedule and request any needed details (including GPS coordinates or a pin, if available) to complete the second attempt.
13.7 Customer response deadline. You must respond within seven (7) days of our request for additional details. If you do not respond within that timeframe, we may pause scheduling and the seasonal placement may be impacted.
13.8 Forfeiture of a seasonal placement. If we are unable to complete placement after two attempts for that season, the seasonal placement may be forfeited at our discretion and will be considered used for Plan purposes.
13.9 Plan fees. Peace of Mind Plan fees are generally non refundable once paid.
14) Disclaimer of warranties
To the maximum extent permitted by law, we disclaim all warranties, express or implied. We do not guarantee that cemetery staff or third parties will allow decorations to remain, or that decorations will not be affected by weather, animals, theft, vandalism, or maintenance.
15) Limitation of liability
To the maximum extent permitted by law, TMT is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to an order is limited to the amount you paid for that specific order.
16) Disputes, governing law, and venue
These Terms are governed by Tennessee law. Any dispute must be brought in a court of competent jurisdiction in Tennessee. If a claim qualifies for small claims court, the parties may pursue it there.
17) Updates to these Terms
We may update these Terms from time to time. The Terms in effect at the time you place your order apply to that order.

Non-Sharing Clause: We do not share your data with third parties for marketing purposes. Tennessee Mountain Tributes LLC will not sell, rent, or share the collected mobile numbers.
